The underground room where the boiler had been installed had not been in the slightest adequate to the technical and safety requirements and did not guarantee sufficient ventilation; the system had not been tested; moreover, not only had it not been turned off, while waiting to resolve the anomalies and malfunctions of the system, which continually went into lockdown, and recorded repeated microexplosions, but it had also been increased, in terms of power, time and functions; its maintenance, as well as installation, instead of an authorized assistance centre, had been entrusted to a person completely lacking the necessary competence and preparation, co-responsible for the omissions and violations, who even fatally tampered with it by disconnecting a pipe .

With the decisive consequence that the smoke evacuation duct was detached and the carbon monoxide saturated the entire environment, also invading the rooms. All of this, made even more serious, in an accommodation facility that welcomes dozens and dozens of guests. The accusations made by the Public Prosecutor of the Milan Prosecutor’s Office, Dr. Isabella Samek Ludovici, holder of the criminal proceedings for the tragic death and very serious injury caused by acute carbon monoxide poisoning respectively of Francesco Mazzacanejust 24 years old, from Torre del Greco, and his partner Pietro Caputonow 21 years old, from Torre Annunziata, which occurred on 9 November 2022 while the two young Neapolitans were staying at the Linate Residence in Novegro di Segrate.

At the end of the preliminary investigations, the Deputy Prosecutor therefore requested the postponement of trial for the two subjects registered in the register of suspects: Claudio Giuseppe Gasperinseventy years old, from Segrate, as legal representative of the company Residenza Segrate Centro srl, owner of the accommodation facility where the tragedy occurred, in via Carducci 7, as well as manager of the same, and Ion Grubi42 years old, of Moldovan origin but resident in Pioltello, the plumber who had been entrusted with the installation and maintenance of the “illegal” boiler which caused the dramatic event. They will have to answer for the crime of voluntary manslaughter, with the aggravating circumstance of having also caused serious personal injury to another person: Caputo survived but after having miraculously emerged from a post-anoxic coma with complete loss of consciousness, for a prognosis well above the forty days and consequences that he will carry with him for his entire life.

Responding to the request, the Gup of the Milanese Court, Dr. Sonia Mancini has thus set it for 26 September 2024at 11.10, at the Palace of Justice in via Freguglia, the preliminary hearing of a trial from which the family members of Mazzacane and Caputo, who are all assisted by Studio3A-Valore SpA, expect the truth and above all sentences appropriate to the serious and guilty disputed conduct.
