Distinguished Mr. President,
The reform that establishes differentiated regional autonomy, now known as “Spacca-Italia”, dissolves the unity of the country and shatters national solidarity.
The reform is the result of an exasperated regionalism pushed to the limit of secession, that of the rich, to the detriment of citizens who live in the areas of the country less equipped with infrastructure and services.
The rights of the person, such as the right to health, which art. 32 of the Constitution defines “fundamental”, they will no longer be guaranteed in conditions of equality in any part of the national territory, but will be guaranteed in conditions of variability and inequality, practically linked to the residence certificate.
The right to education will also be affected in the same way, with the State losing the exclusive power to dictate the general rules of the subject. The differentiation of the training offer and the heterogeneity of the programs will break the identity of the values on which national unity is based, reducing the fundamental norm of the art. 5 of the Constitution, which guarantees the unity and indivisibility of the Republic, at the level of only a formal and pathetic proclamation.
The Spacca-Italia reform took shape through an ordinary law with which it claims to undermine the constitutional structure by doing violence to the hierarchy of laws as is made clear – among others – by the case of the LEP (whose definition is regulated by the art. 117, 2nd paragraph, letter m) of the Constitution, must have the same process as the laws of Parliament which, instead, will be called upon to express a mere opinion, seeing its role distorted, reduced to that of a merely consultative body .
Distinguished Mr. President,
the presidential referral referred to in Article 74 of the Constitution represents a preventive control function, aimed at guaranteeing the overall coherence of the system: coherence of the constitutional and democratic system potentially compromised by the bill in question.
We therefore ask you to evaluate the opportunity to exercise your constitutional prerogative, precisely to safeguard the overall democratic structure, within the scope of coherence and regulatory compliance of the bill on Autonomy with the fundamental principles of our Constitutional Charter. .
