The measure involved an honorary deputy prosecutor and a doctor

This morning, following an investigation coordinated by the Public Prosecutor’s Office of Benevento, the financiers of the Economic-Financial Police Unit – Gico di Lecce have executed an application order of the personal precautionary measure of the house arrest against an honorary deputy prosecutor and a doctoraccused of gang sexual violence.
The honorary deputy prosecutor, at the time of the events, was serving at the Public Prosecutor’s Office at the Court of Lecce, and the cardiologist practices in a hospital in Benevento. The aggravating circumstance of having been carried out by a public official in the exercise of his functions was contested since the Benevento doctor, with the active participation of the other, “in the course of apparent cardiological medical examinations, carried out highly intrusive acts on patients’ sexual freedom who were induced to undress and be groped by the doctor and the honorary deputy prosecutor who qualified as a colleague of the cardiologist”. Everything “was filmed by the two”.

The investigations started from the transmission of the relevant documents by the Public Prosecutor’s Office at the Court of Potenza since, during the course of a differently oriented investigative activity, the circumstance emerged that one of the two suspects, honorary deputy prosecutor at the Lecce Prosecutor’s Office, he went to a hospital located in the Benevento area and that, during the aforementioned trips, he was in the habit of impersonate a healthcare professional e to carry out systematic acts of sexual violence together with one’s accomplice and groping of unaware women formally undergo a medical examination. Following the acquisition of the crime news and the necessary investigative investigations aimed at identifying the elements that emerged, essentially consisting of the results of the technical activity carried out with the use of the computer sensor during the investigative activity carried out by the Public Prosecutor’s Office of Potenza and further wiretaps ordered by the Benevento Public Prosecutor’s Office, in June 2023 a precautionary measure was requested against the two men for aggravated group sexual violence, as well as for abusive practice of the medical profession, illicit interference in private life and illicit dissemination of images and videos .
The request for a precautionary measure was rejected by the investigating judge at the Court of Benevento, only to be appealed by the prosecutor and submitted to the Review Court of Naples. The appeal judgment concluded in February 2024 with the acceptance of the public prosecutor’s appeal, with respect to the conduct of aggravated group sexual violence contested against the two suspects and with the application of the personal precautionary measure of the home certificates. For the remaining part of the requests, the appeal was rejected. Both the defenders of the suspects and the prosecutor presented an appeal to the Court of Cassation which, on 13 June, declared the appeal presented by the defense of the suspects inadmissible and accepted the appeal of the Benevento Prosecutor’s Office for the remaining charges. In this way, the head of the order of the Court of Naples relating to the application of the precautionary measure of house arrest against the two suspects has become enforceable, while the Court of Review of Naples will now be called upon to rule again on the appeal of the Public Prosecutor relating to requests currently not accepted. They were carried out by the PEF Unit of Lecce, numerous local and home searches with seizure of computers, tablets and smartphone devices in use to the two suspects as well as numerous digital audio/video recording devices available to the suspects and other people.
