A significant victory for consumers and a stroke of justice in the fight against “ghost” construction work related to Super bonus 110%.

The Treviso court issued a sentence condemning the company AGM Group srl, based in Conegliano, to reimburse approximately 50 citizens defraudedfollowing a legal battle promoted by Assoutenti, the association that protects consumer rights.

The context of the story

The story dates back to 2021, when numerous citizens of Veneto and Friuli Venezia Giulia they reported to Assoutenti the serious non-compliances by AGM Group, a general contracting company specialized in the management of works related to the Superbonus.

Although customers had paid advances varying between 500 and 1,500 euros, the company had not started any construction work, leaving the construction sites at a total standstill. The bureaucratic procedures were blocked and there was no response to the numerous requests sent by consumers.

The Assoutenti campaign and the legal action

Assoutenti, faced with numerous complaints, collected a series of documents which highlighted the failure to implement the interventions promised by AGM Group.

In many cases, the company limited itself to providing feasibility studies that were often incorrect and unusable, while consumers also paid for technical checks without then obtaining reimbursement for the work never carried out.

Determined to defend citizens’ rights, Assoutenti promoted legal action in the Treviso court, carrying out a campaign that highlighted the company’s systematic failures to comply.

The court ruling

Today, the Treviso court fully accepted Assoutenti’s arguments, declaring the termination of the contracts signed by citizens with AGM Group and ordering the company to return the sums received. The ruling underlines the seriousness of the non-compliance by AGM Group, reiterating the importance of respecting contractual obligations and consumer rights.

The lawyers Alessia Favaro and Antonio Rosetta, who followed the case on behalf of Assoutenti, expressed great satisfaction with the judge’s decision: «The Judge recognized the systematic non-compliance by AGM Group, reiterating the importance of respecting contractual obligations. We are proud to have contributed to this result, which constitutes an important precedent also for other cases connected to the 110% Superbonus.”
