DRIVING DRUNK AND DRIVING IN ALBARELLA, ACQUITTED

He drives on the wrong side of the road, under the influence of alcohol, causing a road accident, but is acquitted because the rules of the road do not apply where it happened.

The sentence issued by the Court of Rovigo and relating to an event that occurred just over two years ago in Albarella is destined to cause discussion.

We are talking about a private island in the Adriatic, owned by the Marcegaglia Group, not far from the Po delta.

It is precisely here that the story that led to the sentence takes place. A group of friends meet for lunch together, but the situation degenerates: the five exaggerate too much until they decide to take a golf cart and start roaming the streets of the island. At a certain point the driver – who later turned out to be drunk – takes a roundabout in the wrong direction, swerves suddenly and one of the passengers, who among other things was not sitting but only clinging to the golf car, falls and hits his head violently, ending up in a state vegetative.

Well, the lawyers of the driver – accused of multiple aggravated road injuries and driving while intoxicated – managed to demonstrate that in Albarella, as a private island, the rules of the Highway Code are not applicable. Result? Acquittal and also the return of his driving license which had been suspended.

A story that is causing discussion and which risks being a precedent: does it really make that much of a difference that an event of this type happened on a private island rather than on a public road?
