“The one approved a few days ago by the Regional Council is not an act that resolves the problem of civic uses of the Civitavecchia residents”. This is supported by the president of the Agricultural Universities of Lazio, Marcello Marian, according to whom the only body appointed by law to resolve these situations is the Commissioner for Civic Uses. In essence, according to Marian, the Region cannot decide autonomously regarding the existence or otherwise of civic uses in Bandita della Mortelle, as there are ongoing trials and a judicial procedure, which is still open.
“In my opinion it is not an act that solves the problem for a part of Civitavecchio – explains Marian – because the only body appointed by law to resolve these situations is the commissioner for civic uses, or the higher magistracies when the commissioner’s sentence is appealed . Therefore the Region cannot decide on its own whether there is or is not a burden there, because there are trials underway and there is a judicial procedure. If that procedure is not closed, no one can say it is there or not. There may be reports from technicians that state one thing or another, but to resolve this situation a definitive ruling is needed. This resolution mandates the municipality of Civitavecchia to issue certifications attesting to the lack of civic use restrictions on those territories, i.e. those of the Bandita delle Mortelle. If I were with the municipality of Civitavecchia, I would wait for the final sentence. How will the Agricultural University of Civitavecchia proceed? I spoke to the Agricultural University of Civitavecchia and they told me that they had appointed a lawyer to resolve this situation, citing the Lazio Region itself and warning it from withdrawing that provision because it is a provision that would put in difficulty not the Agricultural University in as such, but precisely the right that it boasts over those territories. The Region has its powers and it is right that it acts according to its powers, but only when the judge has made a definitive ruling.
