In Marsala new ordinance on “nightlife”

New Union Ordinance prepared by the Municipal Police which regulates the Marsala Movida with immediate effect and until next December 31st. The provision concerns both the administration of alcoholic or spirit drinks and sound diffusion.

As highlighted in the preamble to the Ordinance, the provision is also adopted on the basis of specific Public Security provisions and what emerged in the meetings on the subject held in the Prefecture. The “Movida”, in fact, can result in episodes of disturbance of public peace, acts of vandalism and fights in the summer, which are more frequent in the summer due to the large presence of people.

In particular, the ordinance provides:

With immediate effect a until next December 31, 2024throughout the municipal territory:

From 11.00 pm each day until the following 6.00 am, the sale and administration – both in fixed and itinerant form – as well as the possession and consumption in public places of alcoholic beverages and spirits is prohibited, even if dispensed from automatic dispensers . The ban does not apply within public premises and spaces legitimately occupied by authorized public administration establishments.

The merchants to whom the ban on the sale of alcoholic and spirit drinks, subject of this act, extends are the following:

  1. A) food and drink administration activities, even on a temporary basis;
  2. B) private clubs;
  3. C) artisanal activities;
  4. D) commercial activities;
  5. E) vending machines.

On the occasion of regularly authorized demonstrations and events (festivals, public shows, sporting and cultural events, etc.) which take place on streets and public spaces, in addition to the limitations set out in this provision, the sale, administration and possession of and the consumption of any drink in glass or tin containers in a public place.

With specific reference to Saturday 15 June, in which the event called “Marsala Kite Fest IV edition” will take place, considering the program of public shows expected in the circumstance and the consequent greater expected influx of the public, having consulted the Local Authority of PS , it is provided that the hourly limit referred to in this point, from which the ban on the sale and administration – both in fixed and itinerant form – as well as the possession and consumption in public places of alcoholic beverages and spirits – begins, is brought forward to 10 pm ,00, both in the event area and throughout Via S. L’Africano.

As far as sound broadcasts are concerned, the exhibitors and/or organisers, without prejudice to compliance with every article of law regarding the provision of food and drinks to the public, are also required to comply with the regulations on noise pollution, observance of the sound emission limits, both absolute and differential, which constitute a condition for the legitimate exercise of musical activities, both inside and outside the premises.

Requests for authorization for musical events must be sent to SUAP in the following ways:

  1. a) Via the electronic portal “ featinoneday” no later than 12.00 on the fifth day before the event;
  2. b) All requests received late or in an unconventional manner will not be taken into consideration;
  3. c) If, from the requests received, requests are made on the same evening for two or more activity events in the same street or square, only one will be authorized in compliance with the chronological order of arrival.

The diffusion of music inside and outside public establishments for the provision of food and drinks is in any case subject to the following time limits:

– every day of the week, including holidays and the day before holidays, until 1.00 am the following day;

– the week from 14 to 20 August is an exception, during which the scheduled time can be observed until 02.00;

– any type of musical diffusion both outdoors and indoors by any means remains prohibited, on every day of the week between 01.00 and 09.00 and between 14.00 and 17.00

Furthermore, operators holding authorization to occupy public land are required to maintain the decorum of the public space granted to them, making it constantly free of waste, both liquid and solid, cans, bottles and clutter of any kind.

Failure to comply with the Ordinance, even a single prescription, will result in the immediate inhibition of musical activity – both outdoors and indoors – towards the commercial or administration business deemed responsible. In the event of repeated non-compliance, including with the sanctioning measures, the defaulters may incur heavy sanctions such as the temporary closure of the business and the revocation of the concession for the occupation of public land as well as the confiscation of the equipment for broadcasting music.
