It ends with a precautionary measure of suspension from the exercise of public functions for 12 monthsthe complaint sent to the Prosecutor’s Office in May last year by the extraordinary commissioner of the ASP of Catanzaro, Antonio Battistini, against two managers of the healthcare company. Specifically, we are talking about the clinical engineering manager and the secretary manager of the independent evaluation body, suspended from service for alleged offenses committed in the procedures for defining the 2019 productivity bonus to be paid to employees.
Anomalous accesses to the computer system
It was a process that lasted a long time precisely because of some anomalous accesses to the computer system company which aroused suspicion in the president of the OIV and in the extraordinary commissioner of the ASP. The latter, as soon as he took office, had in fact turned to the body to request the rapid conclusion of procedures preparatory to the payment of the productivity bonus.
Internal investigation
However, during the work, anomalous accesses were detected to the IT system which contains the data of individual employees. The episode leads to an internal investigation and then in a report delivered to the Prosecutor’s Office in which it was highlighted behavior apparently criminally relevant of the two managers; a circumstance which then led to the resignation of the body, at the end of the procedures for defining company productivity bonuses.
The resignation of the Oiv
While the investigation activities by the judicial police were proceeding, the ASP therefore prepared the new tender for the appointment of the new bodyconcluded in the autumn of 2023 with the designation of three new professionals who remained involved until last March in the procedures for defining the 2020 productivity bonuses, paid in employee payslips.

A particular year, marked by the Covid pandemic overturned all the objectives previously assigned and revised in light of the health needs generated by the emergency in progress. In five months of work, the members of the organization managed to reconstruct the elements necessary for the payment of the bonuses expected by employees for some years. The disbursement of the sums was recently followed by the news ofapplication of the precautionary measure of the suspension from the exercise of public functions for 12 months for the two managers.
Danger of repeating the crime
The investigating judge writes in the order: «It is considered to exist the current and concrete danger of recurrence of crimes of the same kind as those committed. This danger can be deduced, first of all, from the concrete modalities of the act, which denote an undoubted objective gravity, which must be deduced first of all, from the marked propensity towards illicit activity manifested” by the two managers “who, abusing their role, they modified a reconnaissance report for purely personal and utilitarian purposes”.

Reached by telephone by LaC News24the extraordinary commissioner, Antonio Battistini, commented on the precautionary measure imposed on the two managers: «It is a legal case triggered by the company, which intends to reaffirm itself as the first guarantor of legality and continue to prosecute illegal behavior in every way. The only regret is caused by the fact that theThis incident has generated and continues to generate delays in the disbursement of emoluments, with damage to all employees. For this reason we must all together combat illicit behaviour. I want to thank the trade unions for the trust they have placed in the company on this occasion.”
