POZZUOLI – The happy news for the former mayor, Vincenzo Figliolia, arrived at one in the morning yesterday when the police from the Pozzuoli station knocked on the door of his house to notify him of the release order ordered by the Review Court of Naples. “I’m finally free” he exclaimed after 142 days spent under house arrest and a week of detention in the Poggioreale prison. Once the three conditions that have supported the precautionary measure so far (pollution of evidence, danger of escape and repetition of the crime) no longer exist, Figliolia was able to leave her home yesterday to hug her family and friends again. Suspended in recent months as city councilor by virtue of the precautionary measure that triggered the Severino law, Figliolia could now also return to the opposition benches where he has currently been replaced by Angelo Lucignano.

THE SUFFERING – «Obviously he is very tired due to the long period of painful detention, in any case he is happy also because he did not expect such a prompt response from the Review. He suffered a bit while waiting for the execution of the court order which, although issued in the afternoon of June 11th, was carried out at one in the morning of the thirteenth. I am very happy, after what I consider to be an extremely long period. Now we will be able to work with serenity and prepare the process as best as possible” explained the lawyer Gigi De Vita, his historic defender.

THE PROCESSES – Figliolia as a free man is now awaiting two trials for the Rione Terra case: the first, celebrated with immediate judgment, sees him accused together with the Pozzuoli entrepreneur Salvatore Musella and the former national leader of the Democratic Party, Nicola Oddati, for corruption , auction rigging and illicit influence trafficking, crimes for which precautionary measures have been taken. The three will have to appear before the VII criminal section (college C) for the hearing on October 3rd; the second trial, however, always sees Figliolia accused together with all the others involved in the legal matter, for the crimes not covered by the precautionary custody order. The hearing has been set for June 27 and on that occasion the investigating judge will also have to rule on the request made by the public prosecutors Stefano Capuano and Immacolata Sica regarding the crime of criminal association, a charge provided for by article 416 of the penal code which it had previously been “removed”.
