THE CONVICTIONS FOR EXTORTION AGAINST THE ROMAN ENTREPRENEUR ANTONIO AND THE FORMER CHIETI COUNCILOR CANDELORO PAOLO CONFIRMED – THE COURT OF CASATION CONFIRMS THE CONVICTION JUDGMENT OF THE COURT OF APPEAL OF PERUGIA.
At the hearing of 04 June 2024 there Court of Cassationand confirmed the sentence issued by Court of Appeal of Perugia of sentencing to 3 years and 6 months of imprisonment for the entrepreneur Romano Antonio and the former councilor of Chieti Candeloro Paolo, found guilty of extortion against workers. In particular, The Romano and Candelorothey forced the workers De Simone Nicola, Esposito Francesco And Lanzano Salvatore to sign blank sheets which they filled in with resignations if necessary and they used this system as blackmail to make them work 12 hours a dayswithout paying overtime, holidays, 13th and construction fund.
Through this system, the entrepreneur and the former councilor illegally pocketed overtime, holidays, 13th and construction fund that were due to the workers.
There Court of Appeal of Perugiawith sentence of 03/29/2023pronounced following the ruling of Court of Cassation of 07/12/2020 with which the acquittal pronounced by the Court of Appeal of L’Aquilaaccepting the thesis of the defense of the civil parties represented byAttorney Vincenzo Espositoof the Nola Forumhad already deemed the guilt of Romano Antonio and Candeloro Paolo for the crime of extortion, sentencing them to a prison sentence of 3 years and 6 months and confirming the compensation of damages in favor of the civil parties De Simone Nicola, Esposito Francesco And Lanzano Salvatore.
Against the ruling of Court of Perugia the defendants had appealed to the Supreme Court. The Attorney General’s Office at the Court of Cassation he concluded by requesting the inadmissibility of the appeals, conclusions fully shared by the defense of the civil parties. The Court of Cassationat the hearing of 04/06/2024declared the appeals inadmissible, confirming the sentence issued by Court of Appeal of Perugiathus becoming irrevocable the conviction for extortion against the entrepreneur Romano Antonio and the former councilor Candeloro Paoloestablishing a measure of justice for the poor workers.
The legal case involves three workers residing in Afragola (NA)such De Simone Nicola, Esposito Francesco And Lanzano Salvatorewho in 2011 denounced some occult entrepreneurs such Romano Antonio (inhabitant of Casoria) Candeloro Paolo (inhabitant of Chieti – who also held the position of councilor for Municipality of Chieti). Specifically, the story reported is the following: The Roman Anthonya hidden entrepreneur, recruited workers from the Neapolitan area for work in the area of Chieti and Pescara. The workers had to obey the directives of the Romano Antonio and Candeloro Paolo, working for 12 hours a day, without overtime, without holidays, without 13th and construction fundforcing them to sign blank sheets of paper every month under threat of not paying their salary or losing their job. These blank sheets were then filled in if necessary with resignations and nothing to demand. Therefore, following the outcome of the complaint they were sent to trial Romano Antonio And Candeloro Paolo at the request of the Public Prosecutor to the Court of Chieti Dr. Falasca on charges of aggravated extortion 629 cp and art. 628 cp. On 03.20.2018 sentence was issued by Court of Chieti section. Collegial paid by Romano Antonio And Candeloro Paolo with which they were sentenced to 6 years of imprisonment each and to compensate the civil parties for all damages. The responsibility of the two accused was confirmed by the Court of Appeal of Perugia and reconfirmed by Court of Cassationthus becoming irrevocable.
