The Municipality of Cuneo recalls that it was set for Thursday 6 June 2024 at 2 pm the new auction procedure for the building area of via Piccapietra, in the Madonna dell’Olmo area. In order to make the concrete implementation of the completion of the building intervention easier, and prevent any degradation of the area, as part of the Partial Variation n. 31 to the General Town Plan of the Municipality of Cuneo (approved with CC Resolution no. 9/2022), now fully operational, and in view of this new auction experiment, the following has been established:
-That the entire area of the General Regulatory Plan identified as “ATF1.MO1”, already subjected to the PEC procedure (Agreemented Executive Plan), has been divided into four autonomous and operational sectorstherefore not obliging the operator concerned to intervene simultaneously on the entire area in question;
-As a consequence of the previous point, the construction of the sector intended for free private construction will not entail the obligation to also build in the sector intended for ERP (Public Residential Building). The building interventions in the sector concerned will only be subject to the prior approval of the PEC (Agreemented Executive Plan): the relevant building agreement to be stipulated with the Municipality of Cuneo will regulate every other aspect, including times and methods of implementation of the aforementioned sectors.
Partial Variation 31 concerned multiple urban planning aspects of the municipal territory; among them, the building area defined as “ATF1.MO1”, located in Madonna dell’Olmo, in Via Piccapietra, was also examined. For this area, which was only partially implemented due to the bankruptcy of the proposing company, several auction experiments had been carried out, but all of them were unsuccessful.
The Municipality of Cuneo recalls that, with the ruling of the Piedmont TAR published on 01.30.2023, the appeal brought by various associations against the Partial Variation no. was rejected. 31 to the PRG. The TAR in fact fully agreed with the defense arguments put forward by the lawyer of this Municipality and deemed all the opponents’ grounds of appeal unfounded, recognizing, in fact, the correctness of the administrative procedures implemented by the Municipal Offices.
It is believed that the provisions of Variation 31 to the PRG described above can facilitate the new auction procedure, hoping for the related award.
