INNOVATIVE CONSUMER RULING
The Court of Teramo with two separate sentences sanctioned the controlled family liquidation procedure of a married couple MP and MR from Teramo, associated with the Robin Hood – Konsumer Italia Association and assisted by the lawyer. Berardo Di Ferdinando, defining all their positions separately, and determining the
possibility of debt release after three years. The spouses have undertaken to make available to their creditors only a portion of their salaries in excess of their family needs.
The couple, after losing their home at auction, was required by the bank to pay the debt almost in full, despite the bank having recovered part of the debt from the Court. The bank then seized the spouses’ salary, already burdened by salary-backed loans, affecting their minimum subsistence.
The problems of the Teramo couple date back to over 20 years ago when the wife MR, then unemployed, showed health problems which worsened over time and forced the couple to incur significant medical expenses which forced the spouses to take out loans. Although Mrs MR found work in 2007, the financial situation did not improve due to an assessment by the Revenue Agency which forced the couple to take out further financing. At that point the couple, unable to pay their home mortgage, lost it at auction after the bank had foreclosed on it. Today the couple’s indebtedness amounts to approximately 160,000.00 euros and, thanks to the controlled liquidation procedure provided for by the new Crisis and Insolvency Code, they will have the possibility, in three years and after having paid approximately 30,000 to creditors, 00 euros for MP and approximately 16,000.00 euros for MR in 36
monthly installments, to obtain release from the Court of Teramo from approximately 115,000.00 euros of debt.
