PALERMO – The IACP removed him a year before his contract expired. The judge condemned the autonomous institute for public housing of Palermo to pay 32 thousand euros to the architect and former general director, Vincenzo Pupillo.

The ruling is from the labor judge Dante Marino. The Iacp in 2021 grounds the unilateral withdrawal from the employment contract with “the general notion of just cause and the breakdown of the fiduciary relationship
connected to it”.

The law has set limits. The manager can be dismissed in case of violation of the obligations of correctness and good faith, for “organizational and management reasons” or in the presence of “negative results
on operational performance and organizational behavior”.

None of this happened. On the merits of the work carried out, in particular, Pupillo had a positive evaluation with a score of 85 out of 100. The matter, according to the judge, “integrates the details of a breach of contract”. The dismissal of Pupillo, ordered by the Region, one year before the expiry of the three-year contract was illegitimate.

However, the subsequent revocation of the command was legitimate. Pupillo asked for a higher figure, but iThe judge did not consider that he had suffered damage to his image and a halt to his career.

We remember some of Pupillo’s battles, now retired. One of his is also cited in his appeal: ahad blocked some very expensive external legal consultancy (around 400 thousand euros).

Pupillo had also raised the issue of arrears in water consumption by tenants of Zen public housing. With an injunction, Amap obtained a sum of millions. No one at the Institute had decided to appeal the decision which had become final.

And instead, according to Pupillo, the Institute had no debt. Since the 1980s, thousands of families have not paid for water consumption, or even rent for that matter. Even the transfers of the meters were missing and were not activated by those who illegally occupied the houses. The Iacp wanted to block everything, but the prefect intervened: three thousand people could not be evicted nor the water supply disconnected.

These were properties owned by the Region and a series of entities, many of which have been dissolved (Ina Casa, Icogap, Gescal, Incis), and state property. The Amap bills, however, were sent to the autonomous public housing institute.
