TERNI – The relationships between two neighbors were tense for a long time.
They definitively cracked in 2017, when one of the two, today 74 years olddid two complaints in rapid succession towards the other woman, who is 52 years old.
Ended up on trial with serious charges of damage and personal injury, she was acquitted by the judge, Chiara Mastracchio.
For her, the end of the nightmare came after many hearings, reports and counter-reports, thanks to the intuition of her lawyer Attilio Biancifiori. The lawyer turned into detective and he managed to get proof that fractures of three vertebrae in the center of the process were not related to the punch in the back rifed by the 52-year-old but which were the result of an accident that the woman had had twenty days before the dispute in the condominium courtyard.
The certainty is that between the two, they live in Narni in a group of terraced housesthere has never been bad blood.
Discussions were the order of the day. One morning the 74-year-old, who parked her car in Corso del Popolo, found it again rifled. She is convinced that the crime was the work of her neighbor and goes to report her.
A few days after the most serious episode, which takes place in the villas in Narni where the two women live.
The youngest is sitting on hers scooter with engine running, the other invites her to turn it off because the noise bothers her. In those circumstances the 52-year-old would have hit her with a punch in the back. The woman goes to the emergency room of the Narni hospital, takes the x-ray showing fractures of three vertebrae with disabling outcomes. It is the straw that triggers the second complaint, and then the 52-year-old’s indictment.
The older woman also brings a witness, who confirms the argument and the punch. During the hearings, an expert evaluation by the party’s consultant Luigi Carlini introduces scientific doubts about the dynamics, which undermine the accusatory framework. The endless investigation follows and in front of the judge, who wants to see clearly and orders another appraisalforensic doctors and radiologists parade.
In the meantime, the lawyer Attilio Biancifiori, convinced of the extraneousness of his client, starts investigative investigations on the side. Manages to recover in the archive of emergency room of Narni hospital an x-ray examination that the 74-year-old had done twenty days before the alleged attack took place due to the running scooter on which the woman’s neighbor was sitting. That exam, for the lawyer, is proof that the rib fractures they were pre-existing.
In the courtroom it emerged that the woman who reported her hated neighbor, answering Biancifiori’s questions, had denied having had previous traumas and having undergone x-ray tests before that day.
The pm Andreani in his indictment he asks for the 52-year-old to be sentenced to 19 months in prison but the hospital reports have an impact on the outcome of the trial.
The judge Mastracchio absolves her of all charges.
