“We are at risk like doctors, we need more protection”

The news of the lawyer being stalked, threatened and the victim of two attacks by one of his clients, has made waves in the world of Salerno’s legal profession. What struck his colleagues, criminal lawyers and others, was above all the cry of pain of thelawyer Alfonso Botta and his incessant request for protection, in his opinion, not satisfied. For the president ofBar Association of Salerno, Gaetano Paolino, «the facts that have occurred in recent days against the criminal lawyer colleague are very serious taking into account that the colleague, despite exercising the mandate received from the client with the usual diligence and ethics, was the victim of repeated attacks and very serious, intolerable, vandalism. I know Alfonso and his professionalism well, and I express full solidarity towards him and his family, with firmness and affection, on my behalf and on behalf of the Council.” He then adds: «I trust that the actions of the judiciary and the police, already promptly intervened to protect the colleague and the family, will continue to be suitable and incisive also through the necessary protection and supervision activities to prevent them from occurring again. similar episodes. It is well known that the daily activity carried out by lawyers, especially in the areas of criminal law, is extremely delicate and that timely and effective protections are necessary. As a Board we will continue to monitor and work even harder to ensure full compliance with the functions and the free and independent conduct of the activity. I reiterate my full solidarity with my colleague Alfonso Botta to whom we will ensure, where necessary, the necessary assistance for the immediate future.”

THE UNION

Valentina Restaino, national treasurer of Mga – national forensic union and representative of the same for the Salerno district, points the finger at another problem: the lack of health facilities and assistance for people with psychological problems (as stated in the interview given to Il Mattino by the victim). «Without a doubt we lawyers are at the receiving end of the dissatisfaction and difficulties of our clients. But no more and no less than other professional categories, I am thinking for example of emergency room doctors. Beyond the precautionary measure adopted by the judge, on which I cannot comment as I don’t know the documents, I wonder, reading the account of the facts, why the attacker was never subjected to Tso». And again: «Every day we encounter the malfunctioning of Rems and the protocols to be adopted towards people who have psychological problems and who often, once the TSO has ended or their sentence has been served, continue to be abandoned to themselves. If they have families who can support them, in addition to them, their families are also abandoned. On this point, a change to the regulatory framework would really be needed.”

THE CRIMINAL CHAMBER

For the president of the Criminal Chamber Luigi Gargiulo, however, the problem is linked to a law, such as that of the red code, “which leaks from all sides because the speed of the investigations requested, with regular times, is counterbalanced by a small number of workers”. And not only. For the president of the criminal lawyers, who expresses «solidarity with his colleague who is one of our most valid members», the crime of stalking «is fashionable and sometimes abused even by the victims, for this reason we are sometimes cautious in the measures to be adopted. Myself, together with the deputy prosecutor Rocco AlfanoI held a course for the judicial police commissioners in the Prefecture and both of us encountered the small number of personnel to be applied to these investigations”.
