Today we start from the preliminary sale of the property of the Menditto heirs to the Atena dei Cecere. One by one all the volumes declared and then violated. In the beginning it was Giulia Menditto that the October 4, 2018representing the heirs of Giuseppe Menditto presented a request for a building permit consisting of demolition and rebuilding with use of the possibility of an increase in volume of a maximum of 35% pursuant to the house plan, relating to a property owned by the Menditto heirs.

This is clearly evident from the fact that the 2nd Octoberneedless to say 48 hours before submitting the permit request, the Menditto heirs el‘Atena srl of the Cecere family had stipulated a private agreement, constituting a preliminary deed of sale, already fixing the purchase price of the property for which the demolition and reconstruction with use of the house floor were requested, for an amount of approximately 650 thousand euros. A promise to sell recorded in Aversa on 24 October and transcribed in Santa Maria Capua Vetere on 30 October.

In short, there is no doubt that the idea of ​​creating a new property in via Linguiti had already existed in the Ceceres’ heads since 2018

At the technical office of the Municipality of Aversa, this request was immediately read with interest. Technically in the name and on behalf of the Menditto heirs it is an architect Rascato who concretely moves. He did so on 24 January 2019 by formalizing the drafting and presentation of a project with graphs and the necessary volumetric calculation to which he also added the use of the house plan tool by adding a percentage to the reconstruction which we will then see stands at a figure close to the maximum of the aforementioned at 35%.

The volume declared by the Menditto technician is equal to 4034, 57 m3, equal to the volume to be reduced. Bear in mind that each cubic meter is equivalent to 0.37 square meters that is, a little more than a third. So if we divide a cubic meter to arrive at a third that is 0.33 we produce a slightly different number than what will come out if the divisor is equal to 0.37 which is a little more than a third. Therefore, we are not going to divide by three but by something less, that is, by a divisor between 2.90 and 2.95. This determines that i 4034.57 mc are equivalent to approximately a 1360 square metersthe. Remember this figure because it is up 1360 square meters which is added to a maximum of cubage or flat square footage of the 35% for the house plan.

The demolition of the Menditto property of 1360 square meters could have produced at most a new property of 1846.32 square meters equal to 5466.66 cubic metres.

Let’s go back to the technical documents sent to the Municipality by the Menditto heirs.

The Mendittos “act like lords” and do not fully use the 35% by presenting a reconstruction project for a new property of 5375.80 cubic metres, not using the full 35% possibility for 70.72 cubic metres.

Fix this square footage in your head which is equivalent to 1822, 30 square meters, because this is the amount allowed by law for that demolition with reconstruction. Mr Raffaele Serpico he lives peaceful days and not even the first complaint, probably anonymous, instills fear in him. All this volume should have produced a property with 19 apartments distributed over three floors plus four offices, another two apartments on the ground floor which, from the grammar of the project, it is not clear whether or not they can be counted among the 19 or whether they are a further 2 apartments in added to the 19.

Does it seem normal to you now that a building is built with 19 or 21 apartments, 4 offices and then in the next episode we will see a nice battery of false drying racks, false attics used and residences for a total size of 1822.30 square metres? Since that first complaint begins to make it clear that this operation certainly did not go unnoticed in the city, Serpico and his faithful Giuseppe Minale they can’t pretend not to see. So they organize an inspection but it is clear that they are not yet worried given that this, in concrete terms, produces nothing when the authorization title, i.e. the building permit, which contains 1800-odd square meters on one side and the possible reconstruction of 19 or 21 apartments and four offices of the planned reconstruction represents, we repeat it the second time because this is the crux of the great scam, already in itself a rubbish to the naked eye. This is why the phrase “nevertheless” is used in the judge’s order. Cecere, Minale and Serpico have probably already thought about how to fix things by having the specialist intervene Gennaro Pitocchi. And here punctually, as a result of the building permit, perhaps with some censorship, a SCIA arrives a couple of months later, a self-certified communication signed by Pitocchi himself which essentially says “Okay, we were wrong, we partially accept the censorships, we remove the four offices we redistribute the apartments to the upper floors and subtract 700.22 m3 from the volume, which is approximately 300 square meters. The goal is to end everything with tarallucci and wine. But this is not enough. Because the complaints are multiplying, the articles of CasertaCe also and the interest of a city councilor Eugenia D’Angelo it becomes annoying.
