The investigating judge validated the arrest and the arrest of the two Albanians, ordering that they remain in prison. This is a 26-year-old defended by the lawyer Michele Coccia (replaced on Tuesday by his colleague Angelo Riccobene) and a 27-year-old, defended by the lawyer Monica Simona Gnesi of the Monza Bar (replaced on Tuesday by his colleague Roberto Beretta).
From what emerged, the 27-year-old – who was grazed in the neck by the shot fired by Scarcella – had a collaborative attitude before the magistrates, as he did immediately after the arrest. He admitted to having entered the house, and it would also be “thanks to him” if the police managed to immediately identify his accomplice (also accused of resisting), ended up in handcuffs on Sunday morning despite the escape attempt. And the 27-year-old pointed the finger at his accomplice, indicating him as the “planner” of the attack: the compatriot would have asked him for help because he was in difficulty, and he would have accompanied him on the expedition. The 27-year-old also spoke about the blow that grazed him in the neck. The former financier, in his words, shot at a short distance and “the light was on”. He “tried to dodge” the bullet and was only grazed, he says. After escaping from the house, the young man called the ambulance himself and then gave all the instructions to the police to track down his accomplice. Which, again according to his story, he had the screwdriver with which the two managed to enter the house and he would also have taken Scarcella’s purse with 500 euros (not yet found).
The former financier is also under investigation
From what has been learned, at least in the initial phase of the investigation the former financier was also included in the register of suspects, for injuries. In essence, a necessary action towards him, in order to be able to precisely reconstruct the dynamics of the facts and also carry out ballistic tests on the gun, which was seized. However, his position could also have already been dismissed by the prosecutor and travel to storage, if legitimate defense is recognized and confirmed. In fact, the law says that, in the event of home invasion, there is always a proportional relationship between offense and defense if the homeowner uses a legitimately held weapon (this is the case of Scarcella) to defend his own safety and his family members. or their assets, when there is no desistance on the part of the criminal and there is a risk of attack.
Despite attempts, on Tuesday it was not possible to contact the former financier’s trusted lawyer, Carlo Boni, for statements on the matter. However, the reconstruction of the facts of the 85-year-old victim of the robbery is known in detail, and was already made available immediately. The man explained that he had not aimed at the thieves, on the contrary «if the wounded one hadn’t moved, he wouldn’t have been even grazed». After being woken up and jerked by two hooded strangers who broke into his house and shouted «Money! The money! “, taken by fear and anxious for his wife who was at home, he grabbed the gun he kept under the pillow, shooting “but not aiming at them”, he underlined. The bullet hole, in the wall of the room, is located 20 centimeters below the ceiling.
