Variant Q3, the Latina Prosecutor’s Office has concluded the investigations and served the notice of conclusion to four suspects for illegal development

The case, as is known, is that in which, on the morning of January 13th, the soldiers of the Investigative Unit of the Environmental, Agri-Food and Forestry Police of the Carabinieri Forestry Group of Latina, led by Major Vittorio Iansiti, executed the preventive seizure decree issued by the GIP of the Ordinary Court of Latina, Pierpaolo Bortone, with whom The request formulated by the Deputy Prosecutor Giuseppe Miliano, in charge of the investigation, relating to the shopping center measuring over 5,000 square meters under construction in the urban center of Latina, located between Via del Lido and Via F. Ferrazza – district, was accepted. Q3.

The kidnapping, then revoked by the Review Courtalso affected the surrounding area of ​​significant dimensions (12,000 square metres) used for roads and car parks, all functional and connected to the shopping center in question.

The investigations conducted by the NIPAAF would have revealed first of all that the SUAP Office of the Municipality of Latina issued, for the construction of the commercial settlement, where three distinct activities of well-known commercial brands were allocated within it, three building permits, despite in the case of especially if it was a unitary project whose dimensions pertained to a “large sales structure” pursuant to Regional Law No. 33/99 whose competence, from the authorization point of view, was not the responsibility of the Municipality of Latina, but of Lazio region.

Specifically, the local public administration would have in fact allowed, with the release of the aforementioned building permits, the “unpacking” of the shopping center into three medium-sized autonomous sales structures, in order to remove control and competence from the Lazio Region to which it is delegated. the authorization for the opening of large sales structures such as the one in question.

The investigations carried out so far had established, according to the Prosecutor’s Office, that, for the construction of the shopping centre, illegitimately and areas classified as public green areas which did not fall within the perimeter of the “Q3 variant”the latter also approved by the Municipality of Latina and which allowed the creation of commercial destinations, as well as areas where there was a constraint of absolute non-buildability deriving from the buffer zone of the State Road 148 “Pontina” as well as, in relation to the accesses (driveways ) to the shopping centre, the absence of the preventive authorizations issued by ANAS Spa as managing body of the public road (coplanar Via F.Ferrazza) was found.

Further critical issues in the construction of the described commercial complex it turned out to be the complete elimination of a significant wooded area which pre-existed in the area before the works which would have required prior authorization from a landscape perspective for the modification of the locations.

Initially, the Public Prosecutor’s Office had also investigated two other people, 5 people including municipal technicians, administrators of the companies that own the area in question and technicians: the owner of one of the three medium-sized sales structures, Eurospin Lazio, Mario Borrelli, and that of Punto Real Estate (Maury’s), Mauro Fusano. Both are no longer among the recipients of the investigation.

Meanwhile, last April 13th, Maury’s had opened to the public and was immediately warned by the local police. After that sudden reopening, the store closed, although no new ordinance was issued from the Municipality and the Suap office ordering the closure.
