The Sports Judge expressed his opinion regarding the match between Audace Cerignola and Potenza, ordering that it be closed.

The Sports Judge,
with the assistance of Irene Papi and the AIA representative Mr. Marco Ravaglioli:
– having seen the reports drawn up by the members of the Federal Prosecutor’s Office and the Field Commissioner dated 24 March 2024 and the consequent order with which investigative investigations were arranged;
– having seen the report sent on 15 April 2024 by the Federal Prosecutor’s Office to this Judge in response to the request made, observe the following.
In both reports of 24 March 2024 drawn up by the members of the Federal Prosecutor’s Office and the Field Commissioner, relating to the match in question, a situation was described which was unequivocally classified as a brawl, in which some members of both teams, who were not fully identified, appeared to have participated. and, in any case, not directly observed by any of the reporters.
Precisely with reference to this classification, this Judge asked for investigations to be carried out to ascertain in the most complete way possible the development of the facts and to proceed with the identification of the members who had taken part in this type of conduct.
However, the investigations carried out did not allow us to clarify the facts and, in particular, which subjects actually participated in the situation described, in a generic way, in both reports originally acquired.
On the basis of this premise, this Judge believes that he cannot adopt any type of measure, as it was not possible to ascertain the quality of the subjects who made the declarations in the documents and the consequent probative value.
It follows that even the behaviors hypothetically reported by some of the members lack adequate evidentiary support, in light of the failure to ascertain their respective behaviors, by virtue of which it would have been possible to attribute or not a sufficient probative value to the relevant accusatory statements.
By virtue of the considerations illustrated above, this Sports Judge

the archiving, at the state of the documents, of the behavior of the members in the situation reported in the reports mentioned above
