The Prosecutor’s Office has closed the new investigation into the Q3 variant and the commercial complex in Via Del Lido. After the first investigation was closed, the Latina Public Prosecutor’s Office began new investigations into the legitimacy of the works carried out and above all the building permits issued to verify compliance with the urban planning provisions. Following the investigations entrusted to the Nipaaf forestry police, the deputy prosecutor Miliano contested the crime of illegal development for having carried out works that led to an urban transformation in violation of the provisions of the urban planning instruments in force.

The case is at the center of a tug-of-war that has been dragging on for months: in the area between the Garden Hotel and Via del Lido a structure has been built with three different commercial spaces, two intended for medium-sized sales structures, one for a catering business. The two supermarkets are still closed despite the seizure of the area being canceled by the Review, a case which is also still open given that the Prosecutor’s Office has appealed to the Court of Cassation against the annulment of the measure.

As mentioned, three medium-sized sales areas have been created in the area. Independent according to the owners, but not according to the investigators. The total volume is approximately 25 thousand meters and was authorized with a variation to the detailed building plan for the Q3 sector which allowed the removal of the pre-existing hotel restriction.

The Prosecutor’s Office investigated the director of the company that owns the area, the professional who drew up the project and two municipal officials who approved the practice. According to the investigations of the soldiers of the Forestry Investigation Unit, there are essentially two irregularities. First, the variant underlying the building permit definitively approved in 2021, after the first dismissal of the proceedings, was launched by the council with the simplified procedure and therefore, again according to the accusation, the modification of the original surfaces could not have exceeded 30 % of the total, while the commercial destination (and therefore modified thanks to the variant) now concerns 100 percent of the structure.

The second dispute concerns the unity or otherwise of the project. According to the prosecutor’s office, the commercial space of five thousand square meters must be considered as a unit having been divided only at a later time and therefore had to be subjected to the regional scrutiny envisaged for surfaces over 2500 square metres. A reading of the documents that the private individual has always strongly contested, claiming that the structures are separate and therefore the permits were obtained following current regulations. The area had two false starts, with openings and closures linked to the dispute over the two driveways on the Pontina coplanar, whose jurisdiction has not yet been clarified: the final authorization could fall to Anas or the Municipality. Meanwhile, the shops remain waiting as do the approximately two hundred workers of the three businesses.
