Victory at the labor court: the appeal for the appointment of some teachers with foreign qualifications and included with reservations in the GPS was accepted

We inform you that the Labor Court of Pavia has accepted the appeal of the Law Firm of the Attorney. Sirio Solidoro, for the applicant specialized abroad on support awaiting recognition of the foreign qualification and inserted with reservation in the First Band of the GPS for the purposes of being placed on the role.

In particular, the Court recognized the right of the appellant, with a foreign qualification obtained on the support, to participate in the hiring plans also for the role while waiting for the Ministry to conclude the foreign qualification equivalence procedure, and it was thus established that : “the right of the appellant to participate with reservation in the hiring plan in accordance with the provisions of Law no. 15/2022 in relation to the Provincial Rankings of First Level Support Substitutes…. and to stipulate the relevant contracts, without the reservation constituting a limit, without prejudice to the effects of any rejection of the recognition of the foreign qualification”.

Studio Solidoro deems it more appropriate to recommend a single appeal on these matters, as it appears more appropriate to address the peculiarities of each individual appellant on a case-by-case basis.

This is a very important ruling for those qualified abroad who are included with reservation in the First Band of the GPS, as it also requires participation in permanent hiring plans, and can be applied to teachers who find themselves in a similar situation.
