A double notification defect – the first relating to the request, the second to the fixing of the evidentiary incident – causes the ‘face to face’ in the courtroom between Redouane Moslli and Vittorino Checchia to fail, considered by the prosecution respectively as the material executor and accomplice of the murder of Franca Marasco, the 72-year-old tobacconist killed last August 28, in the city, during a robbery (details here).

The communication error was caused by the change of Moslli’s defense lawyer (with the lawyer Benedetto Scippa of the Lecce court taking over from his colleague Nicola Totaro of the Foggia court). Nothing happened, therefore, this morning, in room 9 of the Court of Foggia, where the two suspects had also been transferred (Moslli is detained in the Taranto prison, Checchia in the facility in via delle Casermette). The new evidentiary incident will be scheduled very quickly: the Prosecutor’s Office (prosecutor Ida Perrone) will have to notify the new request for an evidentiary incident to the investigating judge and the parties; at that point the judge for preliminary investigations will be able to set a new date for the hearing.

A false start that generated anger and suffering in the family members of the murdered tobacconist: “The pain is renewed and sharpened,” explains to FoggiaToday Rosa, the sister of the victim represented by the lawyer Enrico Rando. “A pain that becomes stronger because now I also know the faces of these people, as well as their names”. The story still shows too many dark sides: “I am convinced that there is much more to discover”continues the woman, who can’t rest.

Supporting her in the courtroom were her husband and daughter (the latter represented by the lawyer Andrea D’Amelio). “My sister was a nice person, she believed in values”, Rosa continues. “She had given up on graduating in Medicine (all she was missing was the defense of her thesis) to take charge of our father’s tobacco shop, who died a month after it opened. I feel betrayed by the presence of these ‘monsters’ in my city. But I am convinced that it is not possible to organize – and I repeat organize – such a murder with these people. It couldn’t have been an initiative of two thugs that I had the misfortune of seeing today. So I wonder who and what was all this organized for?”.

The answer to this question could come during the evidentiary hearing. The robbery, we remember, yielded 75 euros in cash and two mobile phones, but in the victim’s bag the police found over 10 thousand euros in cash. According to the prosecution, the two suspects – Redouane Mossli, 43 years old, and 71 year old Vittorino Checchia – agreed to carry out a series of robberies against commercial businesses in the area. The first, self-confessed, hit the woman with four blows to the abdomen during the robbery; the second, who never spoke to the magistrates, allegedly provided him with the weapon and clothes.

The four blows inflicted by the 43-year-old with a kitchen knife towards the woman – who in the meantime was screaming ‘help’ – two in the abdomen and two in the neck were fatal.
