Business crisis, direct access to databases for judicial offices

The Ministry of Justice has signed three agreements with INPS, the Revenue Agency and Unioncamere and Infocamere.

It will thus be possible for the chancelleries of insolvency courts to have direct and fast access to information on debts, which can be obtained from public databases.

The Business Crisis and Insolvency Code in fact provides that during the proceedings for the opening of the judicial liquidation or the composition with creditors, the Company Registry Office, the Revenue Agency and INPS transmit the financial statements, the tax returns, lists of stipulated deeds, tax and social security debts and any other element useful for fully reconstructing the financial situation of the company in a state of crisis or insolvency.

The agreement – for which the opinion of the Guarantor for the protection of personal data has already been acquired – will be operational in all Italian insolvency courts starting from 2 August, 60 days after publication in the Official Journal of 3 June 2024.

These agreements follow a previous agreement, stipulated by the Ministry of Justice – through the Department for the Digital Transition of Justice, statistical analysis and cohesion policies – which allows judicial officers to access the databases of the Financial Administration, making it easier the electronic search for assets to be seized or subjected to insolvency proceedings.
