The ruling from the Ordinary Court of Rome has arrived on the case of mutiny that occurred between some Napoli players and the club in 2022, when Carlo Ancelotti was on the bench. The player most involved was Allan, from whom the Italian club requested damages of 800 thousand euros. However, the Brazilian managed to appeal through legal proceedings not only to reject this complaint, but also to obtain reimbursement of the fine of approximately 187 thousand euros imposed on him by the club at the time.

The ruling of the Court: “The Court: REJECTS the requests proposed by the Società Sportiva Calcio Napoli SpA against Marques Loureiro Allan; DECLARES that and, as a result, CONDEMNS Società Sportiva Calcio Napoli SpA to pay the sum of €187,008.55 in favor of Marques Loureiro Allan, in addition to interest as required by law from the application to the balance; REJECTS the further requests proposed by Marques Loureiro Allan against Società Sportiva Calcio Napoli SpA; COMPENSATES the litigation costs between the parties in the amount of two thirds and CONDEMNS Società Sportiva Calcio Napoli SpA to pay the remaining part in favor of the defendant, which amounts to €5,000.00 for professional compensation and €571.00 for expenses, in addition at 15% for general expenses and legal accessories. However, the counterclaim with which the defendant requests that the plaintiff be ordered to pay the sum of 187,008.55 euros in its favor is well founded, in execution of the art. 4 of the inter partes private agreement stipulated on 8/3/2018 for the regulation of the exploitation of the defendant’s image rights”. “Indeed, the actress is obliged, pursuant to the aforementioned art. 4, to pay Allan the gross amount of €800,000.00 for each sports season from 1/7 to 30/6, “in 12 (twelve) equal installments with a deferred monthly deadline” and is in default of payment of the following sums: €44,444.44 as the installment corresponding to 2/3 of June 2020, €66,666.67 for the month of July 2020, €66,666.67 for the month of August 2020 and €9,230.77 as the installment corresponding to the period from 1 to 3/9/2020, for a total of €187,008.55. Interest will accrue on this amount as per law from the request to the balance, excluding monetary revaluation, since it is a currency debt and in the absence of allegation and proof of the greater damage referred to in the art. 1224, co.”.
