Hearing postponed this morning in the bunker room attached to Santa Maria Capua Vetere in the maxi-trial on the violence that occurred in the prison of the same city on 6 April 2020, in which they 105 defendants including prison officers, officials of the Department of Penitentiary Administration and doctors of the Caserta Local Health Authority. A witness, who was supposed to be taken to Poggioreale prison where he is now detained, did not arrive at the hearing after having “marked his visit”. It was discovered later that the cause of his absence was the lack of will to testify.
In the process There are already four prisoners alleged victims of the beatings constituted a civil party and therefore interested in confirming the accusations made against the officers during the preliminary investigation phase, who in the latest hearings sent medical certificates to exempt themselves from testifying; two then presented themselves while the Court has already ordered compulsory accompaniment for one of them, Ciro Motti, in recent weeks. Yet this morning he arrived from the Neapolitan prison a fax signed by the doctor saying that Flosco had a “low-grade fever” and “it could not be translated.” The prosecutor Alessandro Milita underlined that Flosco’s impediment did not seem to him to be a significant impediment and asked for forced accompaniment. The president of the Assize Court college, Roberto Donatiello, then read a further communication from the Poggioreale prison in which the doctor specified that the “not” was incorrect and that the prisoner could have been translated but did not want to come and testify. At that point Donatiello ordered forced accompaniment and suspended the hearing. “We note – underlined the lawyer Rosario Avenia, defender of a defendant – that the civil parties in this trial do not want to come and testify”. The trial is taking place in the bunker room attached to the same San Marino prison.
