Today the Court of Cassation confirmed last year’s appeal ruling. Giulia Stanganini is accused of double murder, destruction and concealment of a corpse, and also mistreatment and fraudulent use of her mother’s ATM.

According to what was reconstructed by the investigators of the Genoa flying squad, the child would have been killed – the woman allegedly suffocated him – because she couldn’t bear to hear him cry. As the investigating judge Riccardo Ghio had written in the precautionary custody order, the accused was “inadequate” with respect to the duties of motherhood: her three-year-old son was fed almost completely with baby food and sometimes made him sleep tied to the stroller.

The child’s grandmother had probably understood that her daughter had killed the child and had begun to accuse her of being a murderer. According to investigators, this is why she would also have killed her mother.

During the appeal process the judges declared the woman semi-infirm. At first instance Stanganini was instead sentenced to life imprisonment and was found capable of understanding. During the preliminary investigations she was subjected to two tests: according to the last one, the woman was capable of understanding and wanting at the time of the murders and partially ill when he cut his mother to pieces. In the second instance, a new consultation was ordered which established a schizotypal personality disorder as well as a slight mental deficit. Her lawyer, Chiara Mariani, had asked for acquittal on the merits due to mental infirmity.
