In the end Fabio Giomi was right. The labor judge of the civil court of Siena recognized the illegitimacy of the dismissal of the Pam cashier, who was dismissed after failing the trolley test.
«The company was ordered to reinstate the worker, pay the damages suffered and court costs»said Mariano Di Gioia, secretary of Filcams Cgil. “This is a nice Christmas present, the year ends on a high note”, underlined the worker, who before the hearing had hoped: «I really hope that things go as well as possible and that everyone can be sure that this problem will be resolved in the right way.”
Then taking a step back on what happened to him he added: «This trolley test was not only carried out on me, but also on other colleagues, and this seems to be the path taken by the company. A path that we want to stop, because I, together with the union, consider that the trolley test is not legitimate.”
Before Judge Delio Cammarosano retired to the Chamber, the company and unions had debated in the courtroom for over two hours. “At the beginning there was an attempt at mediation, but it failed, because the company renewed the proposal to withdraw the dismissal, replacing it with ten days of suspension”, explained Di Gioia. The script had already been seen before the prefect about ten days ago, with the confrontation between the parties ending in nothing.
Giomi was not alone. About a hundred people stood in front of the court. Mobilization called by the CGIL, which brought trade union representatives from all over Tuscany to Siena. «We are faced with a dismissal which, as I see it, is completely illegitimate and is the result of a deception, a deception attempted on purpose to fire a delegate of our union», said the Tuscan secretary Rossano Rossi, who then specified: «Dismissing a worker with a deception, attempted the first time without success and then proposed again a second time, is something very serious. Nobody knows where we want to go with this method.”
The story involving Giomi is not an isolated episode in Tuscany. In Livorno two people were fired for the same reason, while in Pisano a worker was suspended for ten days. It is therefore not excluded that now, after the sentence, there could be some reversals in the other cases as well.
