The boy has challenged before the Court of Florence the institute’s provision, also requesting a compensation for wrongful dismissal ma the judge found him wrong and confirmed the removal from the school. It is a work proper recognized by the MIUR which has some rules very precise, even in the behavior to be observed, paid around 25 euros per hour, and which basically consists of standing still and posing while the students reproduce their figures in painting or sculpture.

The model had signed a contract with the Florentine institute for approximately 20 hours per week in October 2021 but in 2023 he was fired in trunk from the top management of the institute for having exchanged effusions out of place with two students on the school premises a few months earlier. In the trial it turned out that it involved kisses, hugs, cuddles and a mutual and consensual exchange of compliments and nothing else, but in a small room of the institute, and during breaks or at the end of the work session. Behavior deemed unacceptable by both the school and the judge.

The managers of the institute, after discovering these behaviors, in November 2022, launched an internal investigation and ascertained the facts, which were considered serious to the point of triggering the immediate dismissal of the “living model” too fiery. In the legal proceedings initiated, the circumstances that emerged in the internal investigations of the school which then led to the dismissal of the boy in February 2023 were confirmed by witnesses, and by the boy himself.

For the judge, the approaches made by the model towards the two students, as reconstructed and admitted by the worker himself, constitute a serious breach of obligations related to the job, and to work within an academic institution. In this sense, in fact, the motivation of the sentence of the Court of Florence which considered the incident “a serious violation of the obligations of correctness, even in the case of a consensual nature of the relationships” is lapidary.

A behavior, always according to the judge, that can disturb the serenity of the students «who they must not feel like the object of sexual attention of the living model which, moreover, nude pose»and of the entire academic environment, improperly used as a meeting place for flirting, precisely because the exchange of effusions took place in the institute’s changing room reserved for models.

The two students they declared have been misunderstood by the modelbecause of some compliments, and he would have gone further even if with the consent of both.
