Caserta. We receive and publish press releases from Fit CISL And UIL Transport regarding waste collection in the municipality of Caserta.

“This follows the joint communication of 20 June forwarded to the Municipality of Caserta relating to our request to make the payment procedures for the fee for urban hygiene services more fluid, especially in the particular moment in which the company will also have to bear the payment of the fourteenth. To date, unfortunately, we must note that a significant delay persists which is extending beyond the historical routine. We remind you that the overall cost of labor in the Caserta production unit absorbs approximately 70% of the robust fee and it is all too simple to realize that an anomalous delay would also burden any other company with related negative repercussions on the payment of salaries to employees. Therefore, we are once again inviting the Municipal Authority to speed up the procedures where Isvec has already guaranteed the payment of the salary for the month of May 2024 and would not be able to make further advances commensurate with the balance of the June salaries and the fourteenth month’s salary expected by the deadline of July 15th.

At the same time, the clear opposition of the undersigned provincial secretariats is represented to the possible activation of the procedure for taking over the management of the urban hygiene services of the Municipality of Caserta of the company awarded the tender for a duration of 6 months extendable for another 6 months, before the pronouncement of the TAR of Campania.

The anxiety that afflicts the workers is caused by a careful analysis of the many aspects that characterize the dispute activated following the awarding of the tender. Without wanting to go into the merits of the matter, on which the Campania Regional Administrative Court will express its opinion in the hearing scheduled for 24 October 2024, however, in this particular tortuous period, which involves the bodies of the Municipality of Caserta, it cannot be ignored that there is a previous and substantial appeal pending from the company Isvec srl which questions the work of the Tender Commission. In this regard, having read with particular attention the ordinance of the Regional Administrative Court of Campania n.02677/2024, there are no good and convenient reasons to proceed quickly and recklessly with the contested subrogation. For our part, while remaining totally neutral, we cannot fail to highlight that the change of management, carried out despite the risk of future invalidation, could lead to damage to the treasury, management difficulties and a long series of inconveniences to the workers.

In fact, workers are already taking advantage of summer holidays according to an already shared shift schedule as required by law and the collective bargaining agreement for the sector. They would find themselves employed by another company without having accrued the scheduled and planned entitlement with the same company.

The same incoming company should manage and take charge of the shortcomings not directly prepared with evident difficulties in guaranteeing the enjoyment of unearned holidays.

Lastly, even in the case of anticipation of holidays not set aside, if the assignment were to be cancelled, the workers would have to financially compensate for the holidays taken but not accrued.

On an organizational level, the incoming company should take care of the rental of suitable work environments and offices, setting up the vehicle fleet, vehicle parking, setting up the workshop, supplying clothing and PPE, work tools and supplies required by its project. All this investment, out of rational prudence, should remain profitable even if spread over the short term. Experience teaches us to be sceptical. There is only the risk of creating alibis to justify an increase in critical issues without the potential possibility of improving operational efficiency and the organizational structure.

Just to mention some of the difficulties that will be encountered and not to mention that the company, in the short term, without the certainty of the duration of the contract, will be reluctant to recognize the 2nd level bargaining purchased from all workers with Isvec.

The undersigned trade unions, faced with the forthcoming decision of the TAR of Campania on the legitimacy of the assignment of the service, would not understand the reasons for an acceleration in favor of one of the companies in question. A forcing that appears illogical as it would risk forcing the workers to face 2 construction site steps in a short period of time with obvious repercussions in terms of uncertainties of the employment and salary positions of the workers and the fiscal inconveniences that would determine the issuing of 3 single certifications (formerly CUD).

For the aforementioned reasons, the undersigned Trade Unions, hoping for the continuity of the employment relationship until the ruling of the TAR of Campania, should they find the willingness of the Municipal Body to proceed, nevertheless, with the change of management, reserve the right to activate incisive initiatives trade unions”.
