With reference to the reopening of Corso Vittorio Emanuele, the municipal administration specifies the following:
“Corso Vittorio Emanuele has been opened and made passable and will not be closed. Ordinance no. 29 signed by the manager is an autonomous act that does not interfere at all in the administrative procedure that was defined for the purposes of authorizing the reopening of the road. So much so that, today, it was decided to adopt, in self-defense, a measure to annul the same ordinance, as it presents profiles of illegitimacy characterized by excess of power due to manifest contradictoriness, inconsistency, lack of adequacy and proportionality with the ordinance no. 27, issued by the same Sector, on 12 June 2024, in which, from the point of view of logical coherence, the comparison of the protection of public safety and the public interest in the use of the road was carried out.
Therefore, the pre-eminent public interest referred to in the same managerial order no. is confirmed. 27. Having said this, an incontrovertible fact is that the road is absolutely safe. There is no reason, neither substantial nor bureaucratic-administrative, that could justify the presence of even a minimal level of insecurity. The conditions, therefore, for the opening were all there, as duly highlighted in ordinance no. 27 assumed, in the fullness of its functions, by the pro tempore manager who signed it. This whole affair is the clear demonstration of the scruple and expertise with which the municipal administration followed the entire procedural process and the works, demonstrating in an exemplary manner the efficiency of each of its political-administrative actions.
TEverything took place in absolute compliance with current legislation and the paramount safeguard of public safety, taking into account the public interest in the reopening of a fundamental road artery, loudly invoked by the citizens, given that Corso Vittorio Emanuele is a road of considerable importance for traffic in the historic center and beyond. There were, therefore, no impediments to the reopening of the road, as can be seen from a series of documents. Not only the certifications relating to the laboratory tests on bars and ropes for anchoring, but, above all, the report, once the structure is completed, signed by the director of works, in which it is declared that the structural works were carried out in accordance with the structural project approved and in full compliance with the technical regulations in force for construction in seismic areas.
The existence of the static testing certificate also reinforces the irreproachable conduct of the municipal administration. The barriers have been tested, as can be seen from the test certificate itself, for a load significantly higher than the design one. As for the monitoring system, it is specified that it does not constitute a real impediment to the use of the work, as it does not influence in any way the functionality of the slope consolidation works, just as it does not affect its static nature in the slightest, the stability of which is guaranteed from the safety works already carried out and tested. The management order which the press reported today will be the subject of careful evaluation by the administrative bodies responsible for verifying the correctness of the conduct of the parties involved, if only for the responsibility of causing social alarm, both inappropriate and unmotivated“.
