Around 700 students from a private school in Campania whose “equal” status was revoked in recent days are admitted at the last minute to the 2024 high school leaving exams thanks to the appeal promoted by the lawyers of Codacons. This was decided by the Council of State, which overturned the TAR’s decision on appeal.
The appeal was presented on behalf of approximately 700 students of a private institute in Campania, against the decree of the Ministry of Education and Merit, USR Campania, which rejected the request for recognition of the status of private school for the institutes schools managed by CSEM (these are the initials of the company involved).
For the judges of the Council of State (Seventh Section, President Claudio Contessa, Speaker Marco Valentini) “Noting that with a note filed by the defendant administration on 17 June 2024, “the operation under the legal regime of scholastic equality of the secondary education institute called […] until the definition of the merit phase”; Considered that, given the approaching end of the school year and the related exams, it is appropriate, taking into account the recognized existence of the periculum in default, accept the request for suspension of the enforceability of the contested sentence; The Council of State accepts the precautionary request and, as a result, suspends the enforceability of the contested sentence”.
