The Constitutional Court had decreed its illegitimacy in its ruling. The Campania Region, however, continued on, adopting a series of resolutions aimed at granting the administrative coordinators of the council groups and the secretariat managers of the council commissions additional allowances, to which they would not have been entitled, without interruption with the past. What would have resulted is a tax damage of more than 3.6 million euros. A monstrous figure, on which the regional prosecutor’s office of the Court of Auditors has turned the spotlight, which this morning notified to 17 councilors (current and former), managers and former managers of the Campania Region as many invitations to deduce.
The investigation was conducted by the financiers of the Economic-Financial Police Unit, directed by Commander Paolo Consiglio, and coordinated by the deputy general prosecutors Mauro Senatore and Davide Vitale. The turning point in the investigation came at dawn today, with the yellow flames serving 17 managers and former managers of the Campania Region with as many invitations to deduce: they ended up under the lens of the accounting judiciary the president of the regional council, Gennaro Oliviero, and the former president, Rosa D’Ameliothe president of Soresa Spa, the Region’s purchasing center for healthcare spending, Tommaso Casilloand other members or former members of the presidential office of the regional council, such as Vincenzo Maraio, current national secretary of the Italian Socialist Party. Invitations to deduct also for Antonio Marciano, Massimo Grimaldi, Santa Brancati, Lucio Varriale, Flora Beneduce, Ermanno Russo, Andrea Volpe, Fulvio Frezza, Valeria Ciarambino, Loredana Raia (current vice president of the regional council), Alfonso Piscitelli, Mario Vasco and Maria Salerno.
The accounting investigation is based on the reconstruction of all the decisions that developed in the previous, contextual and subsequent phase of sentence 146/2019, with which the Constitutional Court declared the unconstitutionality of the regulatory provisions of the Campania Region which they attributed illicit ancillary economic treatment to the so-called administrative coordinators of the council groups and to the secretariat managers of the council commissions through the creation of special funds established by regional laws.
While the question of constitutional legitimacy is pending, the top bodies of the regional council have instead adopted resolutions aimed at attributing to the same staff an additional indemnity for direct collaboration without interruption with the past. The accounting investigators hypothesize that in this way he would have persisted in recognizing an economic treatment similar to that of a manager «to figures without an adequate professional profile in conflict with the reserve of exclusive competence assigned in the matter to the state legislator, with the national collective labor agreement and with the same regional legislation introduced starting from 2021 as well as in violation and evasion of the constitutional judgment ». The total revenue damage reported, equal to the additional treatment unlawfully attributed, amounts to 3,688,177.41 euros.
