A cyclist defended by the lawyer. Antonio Pelle del forum Reggio Calabriawhile passing on board his own bikes racing on Via Padovahaving arrived near the underpass of the airport runwayremained stuck with the front wheel in the grate placed there horizontally along the entire roadway, being thrown to the ground and bringing bodily damage to the skull-face-nose with wounds and various abrasions on his hands and knees.
The injuries were ascertained at the ED of the Bianchi Melacrino Morelli hospital in Reggio Calabria where he was transported by the Municipal Police who intervened at the scene of the incident. Despite the request for damages made by the cyclist, the Municipality did not provide any compensation.
At the conclusion of the judgment initiated at the Court of Reggio Calabriathe organization was condemned to pay compensation for damages;
the judge highlighted in the ruling (published yesterday) that: “……From the in-depth analysis produced in the documents by the plaintiff’s defense it would also appear that the grate in question is not up to standard, because it was not made with the materials required by law, nor with the necessary markings, rather having a handcrafted workmanship with vertical rods, positioned discontinuously and at different distances from each other. Specifically, some rods were missing and this objectively made the grate treacherous precisely in the case of bicycle transit, due to the obvious possibility that the wheel could get stuck in it…..”.
It is hoped that the Municipality will intervene to replace the drainage grate, in order to avoid further damage to road users, considering that after the event (2018 to date) the grate is in the same condition.
