“Administrative Wild West in the Municipality”. The criticisms after the TAR ruling on noise


L’AQUILA – Center-left press conference yesterday morning on the council measures contested or contested by the administrative control bodies. What triggered the centre-left’s complaint is the latest ruling of the TAR which annulled an ordinance by Biondi with which, last year, the night opening hours of the premises were extended and some provisions on emissions were derogated from acoustics. Only the latest in a series of “failures” according to Stefania Pezzopane, Paolo Romano, Gianni Padovani and Stefano Palumbo.

The TAR’s ruling, the councilors recalled, follows that of the Justice of the Peace regarding autonomous accommodation or, again, the ruling of the Council of State on the appointment of the police commander and, again on the part of the highest body of administrative justice, on co-planning of the school assistance service for pupils with disabilities. In the latter case the Council of State confirmed the sentence of the Abruzzo Regional Administrative Court albeit with different reasons. The judges, in particular, observe that the “Municipality of L’Aquila has substantially predetermined, including details, the service that the contractor should perform, leaving the mere definition of secondary aspects to the co-planning, according to methods not dissimilar to the formulation of the offer technique in the context of a normal tender”.

Judgments, denounce the opposition, which can also cause damage to the treasury as well as inconvenience to citizens and which highlight a “poor planning capacity”.
