Palermo, compensated for flight loss due to illness of a family member

PALERMO (ITALPRESS) – Due to an illness suffered by a relative, the whole family has to give up boarding and the airlines are ordered to reimburse the passengers who remained stranded. These are two distinct episodes which had as protagonists the lawyer Alessandro Palmigiano and the former mayor Diego Cammarata. In the first case, Alessandro Palmigiano was forced not to embark due to his partner’s health problem. The ruling of the justice of the peace, Antonio Cutaia, clarified that the protection of reimbursement for missed travel in the event of health reasons also extends to family members, understood in an extensive manner (in this case to the partner). The other case, which involved Diego Cammarata, dates back to 24 April 2023, when the former mayor was supposed to embark for Rome, and then take a connecting flight and reach New York together with his wife and daughter. On the day of the trip, however, her daughter felt unwell while they were at Palermo airport, which is why her parents took her to the Red Cross station inside the airport, where she was diagnosed a food toxicosis. In the meantime, the flight to Rome had taken off and the Cammarata family had therefore asked the company to travel on the next flight. In the end they had to incur additional costs for the trip which still forced them to arrive at their destination the next day. For the justice of the peace “due to a mix-up of skills between the stationmaster and the call center staff, the procedure was not completed and they had to board the flight the following day, with a significant increase in expenses” and for this reason the company was condemned. “Cancellation, delays, overbooking, missed connections, failure to refund due to illness – comments lawyer Palmigiano – are just some of the cases of which passengers are victims in the field of air transport. We invite travelers not to give in to missed refunds, because there is a European regulation that has established travellers’ rights since 2004 and these two sentences demonstrate that it is best not to give in to the decisions of airlines”.
