An all Asti family saga that sees an accusation of embezzlement intertwined with other events, always within the family.
A few days ago the lawyer was sent to court in Asti Giacomo Giovannini of the Asti Bar, 65 years old, also known for being the founder and treasurer of the Asti section “Amitié San Frontières”.
The lawyer is accused of continuous embezzlement for having appropriated, according to what emerges from the documents, of 998 thousand euros from his mother Domenica, as his support administrator.
The unjustified withdrawals, bank transfers in his favor, payments, would have occurred from 2015 to 2019 and the investigation started from a provision ofon 20.2.2020 with which the Tutelary Judge at the Court of Asti, Sara Pozzettihad formulated one series of serious findings regarding the management of the Support Administrator, not approving any of the reports from 2015 to the final one and transmitting the documents to the Prosecutor’s Office for assessments of competence.
It emerges that the lawyer “he would have failed to notify the guardianship judge” of various expenses and decisions, including “substantial fees in one’s favor for professional services rendered in the interest of the beneficiary“.
“The opacity of the management was aggravated and facilitated by the failure to timely file the annual reports for 4 years, a deposit obtained only after repeated requests from the guardianship judge”we read in the documents.
The matter was “combined” with a July 2020 complaint filed by the brother Piero, dentist from Asti, who had followed the Voluntary Jurisdiction procedure. But the Giovannini brothers have been in dispute for some time and last year the Court of Cassation put an end to another matter which concerned the collection of a professional fee that the lawyer had carried out for their brother in a condominium case in Cesana Turin.
The lawyer had entered into the matter Francis Giovannini, son of Piero, who was later convicted of fraud and in another proceeding the same lawyer Giacomo Giovannini had brought his brother to trial on charges of stalking. The trial against Giacomo Giovannini will begin on October 9th at nine o’clock, before the second section of the Court of Asti in collegial composition.
Giacomo Giovannini is defended by lawyers Pierpaolo Berardi and Mauro Ronco. Reached on the phone, the lawyer Berardi claims: “The accusations made against our client are completely unfounded“.
