BARI – The Council of Ministers, on the proposal of the Minister for Regional Affairs and Autonomy Roberto Calderoli, examined two regional laws and therefore decided to challenge, as stated in the final press release of the Council of Ministers: – the law of the Sicilian Region n. 6 of 04/02/2024, containing “Regulatory reorganization of quarry materials and stone materials”, as certain provisions, exceeding the statutory competences and being in conflict with state legislation on the protection of the environment and the ecosystem, violate articles 9 and 117, second paragraph, letter s), of the Constitution; the law of the Puglia Region n. 16 of 04/09/2024, containing “Amendments to the regional laws 11 April 2013, n. 10 (Deadline for opening pharmaceutical offices for private practice), 24 July 2017, n. 29 (Establishment of the Regional Agency for health and the social – A.Re.SS) and different provisions”, as certain provisions, in conflict with state legislation on the protection of health and coordination of public finance, violate article 117, third paragraph, of the Constitution.
Following the rulings of the Council of State n. 4871/2024, n. 4870/2024, n. 4872/2024, relating to the appeals presented by the company INERGIA SpA against the resolutions adopted by the Council of Ministers in the meetings of 5 October 2022 and 10 March 2022, the Council of Ministers, as stated in the final press release, deemed it necessary to proceed with the renewal of the overall assessment of the interests involved and therefore resolved to express a positive opinion of environmental compatibility on the projects for the construction of the following plants for the production of energy from renewable sources: – wind farm called «Stornara nord» and related connection works, to be take place in the Municipality of Stornara (FG); – wind farm called «Ponticello», in the municipalities of Orta Nova and Stornarella (FG), with a total power of 42 MW; – wind farm called «Tre Perazzi» in the municipalities of Cerignola, Stornarella and Orta Nova, in the province of Foggia, with a total power of 50.4 MW.
