Adalgisa Gamba killed her son but was acquitted because she was incompetent. The Court of Assizes of Naples has acquitted the woman who on the evening of January 2, 2022, Greek’s towersuffocated little two and a half year old Francesco in the sea.

The verdict was heard in the courtroom by the parties and, as expected, was not received positively by the husband. The man in fact wished the woman to become seriously ill, shouting “Murderer, you must die”. According to judge Adalgisa Gamba, she was not capable of understanding when she committed the crime, therefore she cannot be imprisoned. However, she was subjected to probation at a rehabilitation facility which she will have to attend for a period of no less than fifteen years. The reasons for the sentence will be filed within 90 days.

The medical opinions carried out during the psychiatric assessments were decisive. According to what emerged during the investigations, according to the statements of the Torre Annunziata prosecutor, Nunzio Fragliasso, “the gesture would be attributable to the fact that the woman believed that her son was suffering from mental retardation problems, despite there being no confirmation to this effect from a health point of view.”
Professors Giuseppe Sartori, Pietro Pietrini and Stefano Ferracuti instead stated: “We believe that at the time of the facts for which she is on trial, Mrs. Adalgisa Gamba was in conditions such as to exclude the capacity of understanding and will due to the presence of a brief reactive psychosis, a pathology with the value of an illness in the medical-legal sense and such as to have led to a mental condition where the homicidal act was placed as an epiphenomenal manifestation of the subject’s mental disorder which, moreover, very probably would have ended with a concomitant suicide.”
