Viterbo – The INPS is suing the municipality for the unpaid rent of the nursery, but Palazzo dei Priori is objecting.

The Santa Barbara nursery school, in via Friuli 12 all’Ellera, is at the center of a legal dispute between the municipality of Viterbo and INPS, owner of the premises. The INPS, through the company Romeo Gestioni spa, sued the municipality for non-payment of 4,685.18 euros, in addition to interest and expenses, relating to rent.

With resolution no. 164 of 17 May 2024, the municipal council authorized the mayor Chiara Frontini to lodge an opposition to the injunction decree issued by the Viterbo court on 13 May. The defense of the municipality was entrusted to the lawyer Marco Rossetti of Albano Laziale, with a fee of approximately 3,037.84 euros.

The choice to oppose is motivated by the municipality’s desire to recover debts owed to INPS for the same rental contract. The council’s decision was taken on the basis of a detailed report on the facts, which underlines the opportunity to proceed legally against INPS and Romeo Gestioni spa for the recovery of the sums owed.

The case raises questions about the economic viability of the decision, considering that the legal fee is almost equivalent to the disputed sum. However, if the court agrees with the municipality, INPS will also be required to reimburse the legal costs.
