Judge Alessandro Capodimonte acquitted, because the fact does not exist, the legal representative of the company that manages the Conad ‘Diamante’ supermarket in Cattolica, in the Rimini area, on trial for the death of a 47-year-old overwhelmed by a pallet of mineral water. The Rimini Public Prosecutor’s Office had instead requested a 6-month prison sentence for manslaughter. It was April 19, 2022, Easter Monday, when a 47-year-old from Rimini, resident in public housing, died when an entire pallet of mineral water, weighing 280 tons, fell in an attempted theft at the Conad ‘Diamante’ in Cattolica. . The victim’s body was found only the next day by a supermarket employee who couldn’t believe he had found a body in the back of the building. According to the Prosecutor’s Office, the manager of the store had not adequately assessed the potentially dangerous situation caused by the stacking of several pallets of water in an area accessible to anyone, i.e. in the external part of the supermarket at the back, near the car park. The administrator was also accused of failing to prepare suitable signs to indicate the potential danger and therefore the risk of falling from a height. The prosecutor also noted that the victim was guilty of complicity, as that night he broke the film that wrapped the lower pallet and then took three packs of water from the last row of the pallet. The lawyer Massimo Vico, lawyer for the victim’s family, who was a civil party, had requested damages of one million euros. There will probably be an appeal against the sentence, the reasons for which will be filed by August 23rd. According to the defense of the company operating the Conad ‘Diamante’ point, the lawyer Gian Paolo Colosimo, the judge did not believe there was a “causal link between the conduct abstractly referable to company management and the tragic event”.
