Another victory for the Legal Section of the SIAMO Army which deals with extrajudicial practices on a daily basis and cooperates with law firms throughout Italy, through the establishment of actual technical tables created ad hoc for the handling of appeals to the TAR.
Tangible proof of the excellent work carried out by the legal team and lawyers of the SIAMO Army Mauro Cuccu and Filippo Follesa is the recent ruling of the TAR for Sardinia reporting a favorable outcome towards one of our associates, regarding monthly permits for family assistance as required by the art. 33, paragraph 3, of law no. 104/1992.
The ruling upheld the appealcanceling the denial issued by the Army General Staff and underlined that the Administration cannot deny permits if the conditions required by law are met, theregardless of the presence of other family members capable of assisting the disabled person.
The Court’s decision, fully supported by this OS, underlines the importance of workers’ rights in benefiting from paid leave for family care, in compliance with current legislation, not allowing organizational evaluations to the detriment of workers’ rights.
The ruling represents an important legal precedent that strengthens the protection of workers’ fundamental rights in cases of assistance to disabled family members, topics of fundamental interest to the undersigned trade union organisation.
