Published in the Official Journal of the Italian Republic the law of 31 January 2024, n. 3, of the Sicily Region “Various and financial provisions” (already published in the Official Journal of the Sicilian Region on 3 February, ed.), which in article 44 modifies the regional law of 21 October 2020, n. 24, regarding games. Below is the full text of the article:
Article 44
Amendments to the regional law 21 October 2020, n. 24
1. Article 6 of the regional law of 21 October 2020, n. 24,
after paragraph 9-ter the following are inserted:
«9-quater. For the purposes of the provisions of paragraph 1, for the
businesses with a public safety license pursuant to
of article 86 or 88 of the Royal Decree of 18 June 1931, n. 773
(TULPS) not having collection as their exclusive or main activity
gaming using the devices referred to in article 110, paragraph 6,
letter a) of the TULPS as well as for arcades equipped with a license
public safety pursuant to article 86 of the TULPS, for cinemas
betting halls, VLT halls, bingo halls and other venues anyway
equipped with a public safety license pursuant to article 88 of
TULPS, existing on the date of entry into force of this law,
the gearbox is not considered a new installation or new opening
of ownership of the business, the change of representative
legal, change of dealer and change of company
owner of the devices referred to in article 110, paragraph 6,
letters a) and b) of the TULPS.
9-quinquies. They are always excluded from the prohibition referred to in paragraph 1 i
points of sale attributable to the category referred to in article 3,
paragraph 3, letter b) of decree 2011/30011/games/UD 27 July 2011
of the Ministry of Finance, subject to compliance with the parameters
spacers provided for by article 2 of the Ministry decree
distribution and sale of smoking products.».
