Bergamo, the Romanian scam involving the two entrepreneurs in crisis: consultant under investigation

A consultant from Bergamo accused of taking part in a scam against two South Tyrolean entrepreneurs risks being prosecuted owners of a hotel in the province of Bolzano. In financial difficulty, the two paid up 140 thousand euros (then returned by the other former suspects) with the promise of obtaining a bond loan of 4 million euros, which never arrived.

The investigations by the Treviso Financial Police started from the complaint presented by the entrepreneurs, who had turned to the Bergamo consultant to recover an “alternative” loan in order to resolve some financial problems. The man from Bergamo therefore directed them to a consultant from Treviso who, in turn, again according to the Gdf’s reconstruction, proposed as an intermediary a Romanian company, which should have acted in concert with a foreign fund, represented by a Roman lawyer. It would have been the latter who proposed the issue, through the fund he represented, of a 4 million euro bondto be placed on the US private market, with annual payment of interest only and principal repayment only upon maturity of the bond.

Based on these premises, the two entrepreneurs and their partners, according to the accusation, were induced to sign a consultancy mandate with which, in exchange for the bond issue, they committed to paying the sum of 140 thousand euros into a Romanian bank account; however, despite paying for the consultancy, the bond was never issued. Subsequently, the same suspects made the victims sign an “addendum to the consultancy mandate contract”, with which another company, later declared bankrupt, replaced the Romanian company, freeing it from any contractual obligation towards the South Tyrolean hotel.

The investigations by the financiers of the Treviso group have ascertained that the money credited to the Romanian company, after a few days, had ended up at the disposal of the three suspects – the financial advisor from Treviso, the Roman lawyer and the consultant from Bergamo – reported, therefore, in competition, for aggravated fraud from significant damage and from abuse of work performance. Subsequently, the Court of Bolzano, after having ordered the conclusion of the preliminary investigations and having taken note of the restitution of the profits from the crime by the suspect from Treviso and the lawyer, requested and obtained a dismissal for restorative conduct of the positions of these two suspects. The consultant from Bergamo, however, will have to answer for the alleged crimes.
