Settlement proposal 70% rejected and so here is a specific deed – the first of its kind signed since the formal closure of the financial crisis – to put an end to a story that started way back in 2014. The Municipality of Terni and the Bff Bank Spa (formerly Farmafactoring) concluded the 475,800 euro agreement for the credit claimed by Milanese group with signatures of the credit management director Andrea Benettin, of the top debtors management manager Davide Luca Kukaz and the financial activities manager Grazia Marcucci. Quite a complex story.

Credits, interests and injunction

Bff Bank was one of the entities included in the list creditors with enforceable title as part of the post-insolvency procedure of the Municipality. Which? An injunction issued by the court of Terni in 2017 for 286,681 euros for late payment of numerous invoices. However, the amount at stake was much higher considering the interest accrued, compound interest, a further credit for unpaid invoices and also a sum relating to legal expenses. In September 2022 the Extraordinary Liquidation Body sent the Milanese group a settlement proposal worth 303 thousand euros. Outcome? Returned to sender. Also involved is another civil proceeding in court in Terni for the sum of 178 thousand euros due to a summons for unpaid invoices from the Municipality. Tortuous situation.

The resolution

The decisive PEC was sent by the BFF (the proposal is theirs) on 23 April: after telephone conversations and exchange of emails, the parties decided to reach an agreement to close the deal. The amount that the Municipality pays is close to half a million euros with the bank and economy renouncing the pending litigation for Palazzo Spada quantified at over 200 thousand euros. With payment to be paid in a single installment to be paid no later than Monday 13 May. The credits at stake concerned Edison Energia Spa, Gala Spa and Schindler Spa, all companies that sold the credit over time. The mayor Stefano Bandecchi, the councilor Michela Bordoni and the manager Marcucci sign, while the person responsible for the procedure is the highly qualified position Giulia Scosta.
