Viterbo – Drunk man rails against passers-by and damages parked cars, he will not be able to go to Piazza Crispi for a year. In the man’s past there was attempted aggravated sexual violence, threats, escape and resistance to a public official. Now the Urban stalk comes into play for him.
“The police commissioner of Viterbo – we read in a note – has adopted the urban Daspo prevention measure against a Viterbo resident residing in the capital.
Last April, the man was caught by the flying squad in a city square in an evident state of intoxication while he was railing against passers-by, also damaging parked cars.
Also considering the subject’s history of drugs, for crimes against property, driving while intoxicated, damage, attempted aggravated sexual violence, threats, evasion and resistance to a public official, the commissioner’s order was issued, issued at the end of the of a timely investigation carried out by the anti-crime police division of the police headquarters to prevent similar episodes prejudicial to public safety, which banned the subject from accessing and staying in Piazza Crispi for a period of one year.
Failure to comply with the prevention measure is criminally punishable, pursuant to Law no. 123 of 2023, with imprisonment from 1 year to 3 years and a fine from ten thousand to twenty-four thousand euros” concludes the note from the police headquarters.
Presumption of innocence
In the Italian criminal system the presumption of innocence applies until the final sentence. Presumption of innocence which is based on article 27 of the Italian constitution according to which a person “is not considered guilty until finally convicted”.
