After 14 days in prison, Mauro Gianmoena, a 44-year-old from Peschiera del Garda, accused last April of having sold rented cars to some people (including an Aprilian), therefore it is presumed they were not in his possession, was released. He had been transferred to the Regina Coeli prison after investigations by the Prosecutor’s Office and the operation of the Verona Financial Police. He was then also reported by the Aprilia police, again on charges of fraud.

The prosecutors of Verona they had even asked for his transfer to the Montorio prison, but there wasn’t even time to complete the process, because the Venice Review Court, fully accepting the request presented by the defenders Roberto Bussinello and Matteo Destri , declared the immediate “loss of effectiveness of the precautionary measure in place”.

The 44-year-old was therefore able to return to his home where he will be able to live even if it was seized. In this way, the scenario documented on April 17 by the Canale 5 show Striscia La Notizia and then enriched by the stories of the various victims completely changes.

After the broadcast of Antonio Ricci’s satirical news report, Gianmoena was arrested in Rome. According to the Guardia di Finanza, at least thirty cases emerged, with subjects declaring that they had been defrauded and that they had given money without ever receiving the promised cars.

New complaints were already arriving against him and a class action was being considered: now, however, suspicions are wavering.

“On the part of our client, as we have been repeating from the beginning, there was no fraud, because – the lawyers Bussinello and Destri highlight to the Corriere di Verona – in the contracts it was expressly specified that at the time of the sale the cars were in the of redemption and not yet owned by the seller, or the suspect. As regards self-laundering, since there was no fraud, the conditions for this second crime also cease to exist”. Furthermore, according to Gianmoena’s lawyers, “there is not even a risk of the crime being repeated, given that at the same time as the arrest the seals were also placed on his accounts, his companies, even his home”.

Meanwhile, the Adiconsum of Verona published an official note on the issue on 24 April, reiterating its intention to initiate and support the class action.

“I was also contacted by Adiconsum – explains the Aprilian who reported everything to the police after seeing the Striscia La Notizia report on 17 April – a lawyer will also have to contact me to carry out any action. To date I have not received any compensation.”
