the Review rejects the defense’s appeal

The former mayor of Avellino Gianluca Festa remains under house arrest. The judges of the Court of Review of Naples have in fact confirmed the precautionary measure issued on 18 April by the investigating judge of Avellino Giulio Argenio and rejected the appeal of the defence, represented by the criminal lawyers Luigi Petrillo and Concetta Mari, who in a 50-page brief they had supported the inexistence of the circumstantial framework towards the former mayor.

The reasons for the ruling, which effectively confirms the accusatory system of the Avellino Prosecutor’s Office, will be made known within the next thirty days.
Festa is under investigation for revelation of official secrecy, embezzlement, misdirection, attempted undue inducement and corruption in relation to two competitions for traffic policeman and technical officer banned by the municipality of Avellino. The same judges of the Review instead canceled the precautionary custody order under house arrest for the architect Fabio Guerriero, co-investigated with Festa together with the former municipal manager, Filomena Smiraglia. Among the accusations made against him by the Prosecutor’s Office, there are those of embezzlement and misdirection: Festa was caught on camera while taking the computer away from his office.
