According to the investigating judge, there are currently no elements that prove with certainty the crime hypothesized by the Prosecutor’s Office: that of threatening a political body. For this reason, Dr. Rita Cialoni rejected the immediate judgment for Chiara Frontini and her husband Fabio Cavini, under investigation for the now well-known Bruzziches affair.

The mayor herself broke the news, magno cum gaudio, yesterday at the end of the city council meeting: “The investigating judge decided to reject the request for immediate judgment due to the absence of evidentiary details of the crime that was accused of me. The news came an hour and a half ago, I recently received it from my lawyers”, announced Frontini. The mayor didn’t add anything else but what was reported was enough to displace the entire assembly. None of the councilors and councillors, of the majority or minority, wanted to make immediate statements. But that’s it.

The possible implications
The first citizen will be able to celebrate May 1st today and inaugurate San Pellegrino in fiore with a certainly more serene soul, even if the prosecutors Massimiliano Siddi and Chiara Capezzuto – who had identified in the recording of the now famous dinner at Marco Bruzziches’ house sufficient elements to ask for immediate judgment – they will almost certainly move on. The investigating judge’s decision, in fact, does not bind the prosecutors, who at this point will follow the ordinary procedure. That is: notice of conclusion of the investigations, possible request for indictment and preliminary hearing by the preliminary hearing judge. The latter, obviously, cannot be Rita Cialoni, having already expressed her opinion on the matter.
The thesis of the defenses
For the lawyer Giovanni Labate, who defends Fabio Cavini, “the rejection order issued by the investigating judge Rita confirms what I and my colleagues have supported from the beginning, and which we have put in writing in our respective briefs, that is, that the case of 338 in this case does not apply. Now it’s up to the public prosecutor to decide how to proceed.” The mayor is instead defended by lawyers Roberto and Francesco Massatani.
