4/30/2024 – The assembly of Reggio Emilia lawyers has the attempt was foiled to oust the president of the Order, lawyer Enrico Della Capanna, for his statements on fascism and anti-fascism, on the eve of April 25, which caused the uprising of a large group of lawyers mainly from the Democratic Party and the left and which, in a letter, declared themselves “no longer represented” by Della Capanna.

This morning the Order’s assembly was convened in court for the approval of the budget, but for days – in Reggio even the walls speak – it was known that someone would ask for the president’s head with a motion of no confidence, or by voting against the budget, in order to bring the Order into receivership. .

But it didn’t go like this: with a mobilization the likes of which had not been remembered in living memory, the category mobilized to defend the President and his right to express political opinions, even if they are unwelcome to hegemonic thought (but it still is really?) in the city.

Let him get ready the auto-da-fethis morning, this was clear from the mobilization of the media and the presence of anti-fascist exponents, led by the historian and essayist Mirco Carrattieridirector of the Parri institute in Milan.

Instead, the unthinkable happened: a crowd of hundreds of legal professionals showed up at the meeting, which generally brings together a few dozen members, so much so that it was necessary to move to the Assize Court room, however packed everywhere.

The lawyer set fire to the powder around 11.30 am Evelina Carri who defined the president’s writing as “unworthy”, therefore announcing his intention to present a motion of no confidence. Della Capanna noted that the budget would be voted on today, and therefore the topic would have to be dealt with in another meeting. How it would end was clear when the assembly applauded the president himself for the entire duration of lawyer Carri’s speech.

They also spoke Marco Scarpati And Giovanna Favaagain to stigmatize Della Capanna: who however rightly recalled that his predecessors – Celestina Tinelligreat political sponsor of the former prosecutor Mescolini, and also the late Roman Corsi who was elected in the PCI to the city council – they had always done politics without anyone having to complain about it. He also announced that he will respond to the protesters with his own intervention.

At the end the vote on the budget: 154 votes in favor out of 170 voters (probably a record in the assemblies of the Reggio Emilia Order) and 16 votes against. Game over.

President Della Capanna ended up in the meat grinder for having stated in a post on Facebook that “we got rid of fascism in 1945, but in 2024 we still haven’t gotten rid of anti-fascism“. And instead “we should try to free ourselves from it, to build a new society projected towards the future, in which we can share values, ideas, objectives, without sterile ideological barriers that belong to dynamics that our young people don’t even know about. The world moves forward and we cannot remain glued to the past.”

Widely shared statements, especially since the anti-fascism that dictates the law in Reggio (and not only) is the one dominated by supporters of the Nazi-Islamic Hamas, the one that bans Jewish flags in marches, which allows people to shout with impunity “killing a fascist is not a crime ”, anti-fascism brandished like a club against any opponent and which has been silent for eighty years on the massacre that occurred after the war. A sectarian and authoritarian “anti-fascism” when most distant from what should be a common democratic feeling, which Italy had also achieved with difficulty after the Cold War and which had its highest point in the dark days of kidnapping and assassination of Aldo Moro.

Considerations not only legitimate, those of the president of the Order, but fully within the constitutional framework. And yet seized upon by the control room of the Reggio Emilia system as an opportunity for revenge on that unacceptable revolt of the lawyers against Celestina Tinelli, already a lay member of the CSM in the PCI quota, who had led to the election of Della Capanna. As it turns out, she ended up like the famous mountain pipers…
