CERVICATI – “What is happening in our municipality is truly incredible. Article 141 paragraph 2 of the TUEL is violated and it is considered appropriate to call electoral rallies for the next electoral round for the renewal of the municipal council. We are absurd.” And the complaint that comes come on minority councilors of the ‘Common Project for Cervicati’ group that following the failure to approve the 2024/2026 budget forecast, the Prefecture of Cosenza, with decree prot.44261 of 04/19/2024, appointed the commissioner ad acta in order to approve the budget forecast, relating to the financial year 2024/2026, within 10 days. This decree is flawed due to the failure to indicate the provision, by the Prefecture of Cosenza, for the dissolution of the municipal council, as required by current legislation.
“In fact – he specifies their lawyer Graziano Di Natale – article 141 paragraph 2 of the Consolidated Law on Local Authorities states as follows … “when the council has not approved the budget plan prepared by the council within the legal terms, the regional control body assigns to the council, with a letter notified to the individual councilors , a term of no more than 20 days for its approval, after which it replaces the defaulting administration through a specific commissioner. The Prefect is notified of the replacement measure and the procedure for dissolving the council begins. Therefore – he adds – not only did the Prefecture of Cosenza not dissolve the city council with the same decree, but, incredibly, the Mayor, now out of office, called the electoral rallies for the renewal of the City Council on April 25th.
This circumstance, as well as being grotesque, appears outside of any legal logic and breaks the democratic rules on which a community is founded. For these reasons – he concludes – we appeal to the Ministry of the Interior, through the Prefecture of Cosenzato intervene and apply the rules governing the organization of local authorities and consequently decree the dissolution of the Cervicati City Council with the appointment of a Prefectural Commissioner who will lead the Institution until the date of the next administrative elections at this point to be held after the date of 8 and 9 June 2024″
